Terms and Conditions of Agreement

These terms and conditions govern the relationship between Pure Life Expeditions, LLC,   of Salt Lake City, Utah, and you, the purchaser and/or participant, as they apply to the travel bookings for tours as published in this brochure.  No alterations to these terms and conditions may be made by any PURE LIFE EXPEDITIONS, LLC,   employee, authorized representative or agent, unless in writing by an officer of PURE LIFE EXPEDITIONS, LLC. All decisions and matters subject to PURE LIFE EXPEDITIONS, LLC, discretion shall be made by an authorized officer of PURE LIFE EXPEDITIONS, LLC .

Application Procedure
Application for the limited number of openings are processed in their order of arrival.  PURE LIFE EXPEDITIONS, LLC must receive an application signed by the purchaser and/or customer, accompanied by a deposit of $500.00USD, drawn on a U.S. bank which is refundable, if the application is not accepted.  

Mail your completed application and deposit to PURE LIFE EXPEDITIONS, LLC, P.O. Box 17899 SLC, UT 84117.  Our trips are limited to a small number of participants, (usually 10 to 15). Because we cannot hold a space for more than 24 hours, it is advisable to overnight your application (late applications cannot be accepted by fax); please use our P.O. Box 17899, Salt Lake City, Utah 84117 for US Postal Service overnight delivery, or our street address 2160 East 4500 S, Suite 4, Salt Lake City, Utah 84117 for delivery by Federal Express or United Parcel Service. Please also feel free to fax your application with credit card information to: # 801-273-8467.

Payments and Documentation
Final payment is due 60-days prior to departure.  Land documents will be sent approximately 4 weeks prior to customer’s departure.  Note: Airline reservations and arrangements are not included. It is the customer’s responsibility to make appropriate air arrangements, as well as transportation to and from the destination where the travel booking originates, and returns.  PURE LIFE EXPEDITIONS, LLC shall not assume any responsibility for any air schedule changes

Late Bookings
Bookings made within 45 days of departure may be subject to a USD $100.00 per person late booking fee.   Prospective customers are advised to reserve early to avoid disappointment.

Participation and Expectations
PURE LIFE EXPEDITIONS, LLC arranges adventure travel within Costa Rica.  Every PURE LIFE EXPEDITIONS, LLC participant is expected to be positive, motivated, and physically fit. All participants are expected to participate enthusiastically in all of the trip’s activities and to shoulder trip responsibilities with a positive attitude.
The tours described in this brochure are all well within the ability range of the vast majority of average adults, who have the desire to participate. PURE LIFE EXPEDITIONS, LLC makes every effort to be sure that those accepted into the tour are capable of handling both the mental and physical challenges offered. Ultimately, it is each participant’s responsibility to assess the appropriateness of the itinerary chosen for themselves, based on their own health experiences, common sense,  and the advice of their personal physician.

Departures Dates and Prices
Tours are scheduled to operate through December 2007. Prices shown herein are based on tariffs and exchange rates in effect on February 1, 2006. PURE LIFE EXPEDITIONS, LLC, reserves the right to alter prices quoted should inflation, costs of fuel, labor or material,  or foreign exchange rates change.

Not Included in Tour Costs
Fees for obtaining passports or visas, excess baggage charges, inoculations, accident or baggage insurance, taxes that are not included in the tour package chosen,  optional tours, any items of a personal nature, such as phone calls, faxes or room service; excess mileage carried out at the request of the passenger or transportation not specifically listed as included.  Beverages (liquor and soft drinks) and laundry are included at select properties and this will be specified.

Alterations to Tours
If between planning time, and/or during actual travel operation, circumstances require changes, PURE LIFE EXPEDITIONS, LLC, and its suppliers of travel services, reserve the right to vary the itinerary and substitute components of any tour, if surface transportation charges, security matters and/or events beyond their control make such alterations necessary. Suppliers may substitute transportation equipment depending on any variety of factors, including the volume of passengers on the tour.

Cancellation
Cancellation penalties imposed on PURE LIFE EXPEDITIONS, LLC by its suppliers are stringent. The following terms apply effective as of the date PURE LIFE EXPEDITIONS, LLC receives written notice of cancellation.

·            180 days or more prior to departure – $250.00 per person
·            179 -- 91 days prior to departure – 10% of the tour cost, per person
·            90 -- 46 days prior to departure date – 25% of the tour cost, per person
·            45 -- 15 days prior to departure date – 40% of the tour cost, per person
·            14 days or less prior to departure date – 100% of tour cost to include handling fee and liquidated damages for PURE LIFE EXPEDITIONS, LLC.

Refund of Unused Arrangements
As PURE LIFE EXPEDITIONS, LLC prices are based on contract rates, if you cancel while the tour is in progress, there will not be any refund for the unused portion.  

Alterations to Confirmed Bookings
If you decide to change any portion of your confirmed arrangements up to 46 days prior to departure, we will attempt to assist you at an administrative charge of $150.00 per change. Changes within 45 days will be treated as a cancellation and rebooking.

Cancellation Insurance
We strongly advise you to purchase trip cancellation insurance, which PURE LIFE EXPEDITIONS, LLC makes available to you. This can protect you from financial loss in almost all circumstances. Cancellation insurance information for USA residents will be sent to you at time of booking.  PURE LIFE EXPEDITIONS, LLC is not permitted to sell travel insurance to non-USA residents.

Single Room Policy and Shared Rooms for Single Participants
Due to intermittent shortages of accommodations on adventure tours, a single room cannot always be guaranteed, even if paid for in advance. If single accommodations are not provided, an appropriate refund will be made upon your return. If you are traveling alone and wish to share accommodations, PURE LIFE EXPEDITIONS, LLC does not locate roommates on your behalf.

Baggage
Be advised that customers who will be traveling by light aircraft on adventure tours must carry only one medium sized soft luggage or duffel bag. Small light aircraft have limited space for baggage and a weight restriction. City hotels do store luggage for guests while they are out on adventure tours.

 Health Requirements
It is each customer’s responsibility to make absolutely certain to have the proper immunizations before the tour sets out.  PURE LIFE EXPEDITIONS, LLC shall not assume responsibility for the accuracy of health requirements or vaccination information. Malaria is endemic to certain regions of   Central America, including Costa Rica,  and precautions must be taken. See your health practitioner for advice. Prior to travel, required inoculations, if any, must be recorded by customer's health practitioner on a valid vaccination certificate, which the customer must carry for proof of inoculation where required. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking,  do check the U. S. State Department www.travel.state.gov   for relevant information relating to travel toCosta Rica, and the U. S. Centers for Disease Control www.cdc.gov/travel/camerica.htm  relating to health issues. It is the responsibility of each participant to check medical requirements for wherever travel is planned.

Responsibility
PURE LIFE EXPEDITIONS, LLC is not the source or supplier of the travel services requested, and acts solely as a booking agent for disclosed principal supplier hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services abroad. Each of these companies is an independent corporation with its own management, and is not subject to the control of PURE LIFE EXPEDITIONS, LLC. Customer is advised that the suppliers whose names appear in the tour travel documentation are those actually responsible for providing the travel services purchased, and  consents to and requests the use of those suppliers.

All bookings are accepted by PURE LIFE EXPEDITIONS, LLC as agent for independent overseas ground and tour operators in Costa Rica. The transportation, accommodations and other services provided by the identified ground and air operators offered are subject to the terms and conditions contained in the tickets, exchange orders or vouchers issued by them and/or their suppliers. Because PURE LIFE EXPEDITIONS, LLC does not have the right to control the operations of the independent operators and their suppliers, IT IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE which may arise out of these services.

PURE LIFE EXPEDITIONS, LLC reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary or desirable, to refuse to accept or to retain as a member of any tour any person at any time, and to pass on to customers any expenditure occasioned by delays or events beyond its control.

In case of any appreciable variation in its cost, PURE LIFE EXPEDITIONS, LLC  reserves the right to adjust its rates.

Risks/Safety
PURE LIFE EXPEDITIONS, LLC draws your attention to the fact that there are certain inherent risks in traveling to areas of the third world, where wild life is prevalent, and adventure tour camps are by their nature remote, and there are unpredictable forces of nature. Your participation constitutes acceptance at your own risk. 

It is your sole responsibility to seek and take all appropriate medical advice relevant  to your health prior to departure as to whether or not you are fit enough to undertake the itinerary booked.  PURE LIFE EXPEDITIONS, LLC shall not be liable for illness, injury or death sustained on a tour sold by PURE LIFE EXPEDITIONS, LLC.

Medical Treatment
PURE LIFE EXPEDITIONS, LLC shall have the right to give first aid to the participant and to engage the service of a physician or dentist, or to hospitalize a participant if it deems necessary. The cost of such service, including expenses for both the participant and the staff member who accompanies him/her during the period of illness and in rejoining the group, medicines and ambulance service, but excluding first aid service, shall be paid by the customer and/or the parent/guardian.

Force Majeure
"Force Majeure" means, in relation to PURE LIFE EXPEDITIONS, LLC,   any circumstances beyond the reasonable control of PURE LIFE EXPEDITIONS, LLC,   (including, but without limitation, acts of God, explosion, flood, tempest, forceful wind, fire or accident, war or threat of war declared or undeclared, sabotage, insurrection, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions or other untoward occurrences).

If PURE LIFE EXPEDITIONS, LLC is affected by Force Majeure, it shall forthwith notify you of the nature and extent thereof.

PURE LIFE EXPEDITIONS, LLC shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, by reason of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure.

If PURE LIFE EXPEDITIONS, LLC, and/or any of its’ travel suppliers, are affected by Force Majeure, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by PURE LIFE EXPEDITIONS, LLC   to you as a result of the non-performance of any  obligations hereunder shall remain in its sole and absolute discretion, although PURE LIFE EXPEDITIONS, LLC  shall use its reasonable efforts to reimburse you where possible. However, PURE LIFE EXPEDITIONS, LLC shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to PURE LIFE EXPEDITIONS, LLC of the Force Majeure.

Regarding civil unrest, once PURE LIFE EXPEDITIONS, LLC has investigated the prevailing situation, as it deems fit, it shall remain in PURE LIFE EXPEDITIONS, LLC's sole and absolute discretion whether to proceed with the trip. You may in such circumstances cancel the trip. However, if, after having made all reasonable and proper inquiries, PURE LIFE EXPEDITIONS, LLC is of the opinion that the itinerary may proceed, no refund will be payable to you and the provisions stated under Cancellations shall apply.

Insurance
PURE LIFE EXPEDITIONS, LLC strongly recommends that you obtain the following types of insurance, which are commercially available:
           

Alterations In Itinerary
Our intention is to follow, as precisely as possible, the itineraries as described in this brochure. Severe weather, unusually high water can necessitate an itinerary change. If a hotel, activity, or area is deleted for any reason, it will be replaced with a comparable one.

Equipment Discounts
PURE LIFE EXPEDITIONS, LLC has negotiated discounts on outdoor equipment you may need to purchase prior to your venture. Once you are accepted into a tour, we will send you further details on this exclusive program.

Equipment Loss or Destruction
Participant agrees to be held responsible for the willful destruction or loss by the participant of any equipment belonging to  PURE LIFE EXPEDITIONS, LLC and hereby agrees to reimburse  PURE LIFE EXPEDITIONS, LLC for such loss or destruction of equipment.  PURE LIFE EXPEDITIONS, LLC insurance does not cover the personal property and equipment of participants or staff. Participants should check their own insurance policies to be sure own  gear is covered against loss, theft, or damage.

Consent
The advance payment OR any other partial payment for a reservation on a adventure tour  constitutes consent to all provisions of the conditions and general information contained in this brochure. The terms under which you agree to take these adventure tours cannot be changed or amended except in writing signed by an authorized officer of PURE LIFE EXPEDITIONS, LLC.

Your Travel Agent's Responsibility
At PURE LIFE EXPEDITIONS, LLC,   we are very proud of our relationship with travel agents throughout the world. To facilitate the reservations process for you, PURE LIFE EXPEDITIONS, LLC, requests its booking agents to provide you with thorough communications pertaining to your booking.  Your agent can assist and inform you on matters such as required documentation, payment schedules and cancellation policies. Your agent will assist you to the best of his or her ability in providing answers and information pertaining to your booking as well as immigration, customs and health requirements. 

Photograph Release
Customer does herewith authorize and agree to the reasonable and proper use by PURE LIFE EXPEDITIONS, LLC of any and all photographs which may be taken of any aspect of the program and which may include the image of the participant.
